Legal Question in Administrative Law in Illinois

Hello, I have a question, I had a gym membership like 2yrs agoI called over the phone and canceled the membership. I received a call from a collection agency yesterday stating I owe them $4,675.00..per my contract I was suppose to write a letter to cancel my membership, so they continued charging me. I was never notified by them that I was still being charged. Can they do that? Am I responsible for the $4,675.00?

Most gym contracts are like that. This is a lesson. Read your contracts and if you want "out" follow the instructions. This is fundamental contract law. At this point, with no further information, it sounds like you are responsible and if you can't say who you spoke with, on what date, etc., you're in the position of having to try to compromise the debt as a settlement or fight the contract as unfair, in court. Take the contract to an attorney for a complete review -- who knows. There may be provisions that violate various consumer laws in it. Or contact the media and see if anyone is interested in exposing gyms for these "hidden" clauses.....
