Legal Question in Appeals and Writs in Illinois

appeal civil decision

I am writing today due to the strong insistence of friends and family, I recently lost an civil suit that even the judge declared we would win..my attorney was incompetant, and I sat in on his argumentation for the post-trial motion..at neither of these did he present an cogent argument nor did he provide the proof and relevence available to support my case, this despite almost 5 years of my having handed him research, supporting documents (most of which were issued by the Feds), and he allowed the attorney for defense to prejudice the jury with blantantly scientifically false information. Indeed, several persons have suggested to me that he was on the take, and his representation was so poor that I begin to think it possible.

How do I file an notice of appeal? WHat grounds present the best chance of success? WHere can I get my hands on the rules and regs about this procedure? Can anyone give me an example of an brief? When do I file that?

I can prove scientifically that the events took place as I state them and are impossible the way defense presents them.

With best regards and sincere hope that you will excuse my typing,

Re: appeal civil decision

The filing of a notice of appeal is a simple matter. Generally, the notice is a short document. The notice of appeal is simply designed to give notice that you are appealing.

The notice of appeal is due 30 days after the judgment or the ruling on the post-trial motion, whichever is later. Your brief on appeal, which contains your arguments in support of reversal or a new trial, will not be due for many months after the notice of appeal is filed. I would be happy to help you with both. Examples of briefs are abundant, and I can provide you with one, but you should consider hiring a new lawyer to prepare the notice of appeal and the brief. The rules are available online, or at your local law library, but they are complex, and general customs, that are not discussed in the rules, tend to color the meaning, interpretation, and enforcement of the rules. Re: appeal civil decision

There are essential deadlines to follow when bringing an appeal. An attorney with experience in appeals should be able to provide information concerning the notice of appeal and other steps necessary to bring your appeal. You may also wish to gather your complete file so that it can be reviewed for any other claims you believe you have.
