Legal Question in Appeals and Writs in Illinois

Illinois Appeals

I'm representing my self pro se, in a driving while license revoked. i'm facing jail time and am contemplating an appeal based on lack of probable cause for the traffic stop. illinois mandatory minimum is 10 days or 240 hours of comm. service. I fear losing my job if incarcerated, even in county. any suggestions? No offense was comitted which warranted the stop, probable cause ?

Re: Illinois Appeals

Contact the prosecutor/state's attorney that's got your file and see if you can work out a deal. You may be able to serve your sentence on weekends only or get them to let you plead to a lesser offense. It never hurts to ask.

I don't know how far you're going to get on an appeal re: probably cause, as it's your word against the cops, and there's a good chance your statements will be deemed self-serving, while the cops' statements will be deemed absolute truth. Of course you've got the right to pursue an appeal, but don't get your hopes up.
