Legal Question in Banking Law in Illinois

Deposit of Check

I have deposited my friend's payroll check in my bank account with her permission, by indicating For Deposit Only on the back of the check. This is becuase she does not have a checking account. I deposit the money and then at the same time withdrawl the money and give it to her. Now she is saying that she wants to sue me for not giving her the money - which is false and for forging her signature - which I did not sign her name. Can she get away with this?

Re: Deposit of Check

No. If you paid your friend the money, then you should not have to pay her again. The trick, of course, is proving that you paid.

In future, you should be careful to get a written receipt if you are going to do these types of favors for people.

For now, if your friend files a lawsuit against you, then you would certainly benefit from hiring an attorney. If you want to talk about your case, please feel free to give us a call.
