Legal Question in Bankruptcy in Illinois

Adding debt to existing bankruptcy

Hello,

I filed chapter 7 and my Discharge of

Debtor was March 31, 2008. Can I

add some additional debt to the file

now?

I have some new medical debt and

pay day loan debt I cannot afford to

pay.

Thank you,

Was the debt before or after you filed? Even if the debt was post-filing, you still have options under the bankruptcy.

If the debt as incurred prior to the filing date (the date of discharge doesn't determine this), then you could reopen your case, vacate the discharge and amend your schedules. This is not cheap as it costs money to reopen a case, and you would likely want to hire an attorney to do this for you to make sure it's done correctly.

If the debt was incurred after you filed, you are not eligible to discharge that debt with that bankruptcy.
