Legal Question in Bankruptcy in Illinois

I have been out of work for awhile now and have had to move back in with my parents. I have an old debt that I had been paying on but the debt just kept getting higher. It was suggested I go into credit card counseling. I did and paid into it faithful for years and the debt was higher than when I went in. Now, another company, Unifund has bought the debt. They took me to court. The appearance fee was waived and I was allowed to defend as an indigent person. I cannot pay them at this time. Now they have sent my bank a third party citation to discover assets. There is nothing in that account. Is there a way a person who has no money can file bankruptcy? I keep hearing its expensive? What are my options.

You need to pay up front to file for bankruptcy because otherwise the lawyer has no more right to collect his fee than any other creditor.

But the good news is that if you are going to file you can stop paying any money to any creditor and just pay the lawyer instead. Feel free to call if you want to talk.
