Legal Question in Bankruptcy in Illinois

I filed Bankruptcy Feb 12, 2008, On Feb 16, 2008 I found my son dead and proceeded with funeral arrangements, etc. When I went for my final (what I thought was my final hearing in Rockford) they asked if anyone in the family died and I came into money in the next 6 months to let them know. Well, I told them about my son and the trustee then said the life insurance money that I buried my son with, wasn't mine to spend as it became part of the estate. I had no clue before hand, and now he is asking for the entire amount plus my past years income tax plus court costs to the tune of over 22K.

I just received the trustees suit yesterday and of course the atty I had, will no longer deal with the case.

I am not in a position to pay 22K, and not really in a position to have to pay another atty,, but I NEED help.

Please!!!!

My condolences with regards to your son. This is a difficult position you find yourself in, indeed. If your son's death came after you filed for Chapter 7 bankruptcy, there is an argument there that says it is not part of your estate. What information have you provided the trustee with?
