Legal Question in Business Law in Illinois

Airline fuel surcharges

I booked a tour with a tour agency agreeing to the price they wanted for a tour. A down payment was made along with full payment for travel insurance. Now they want to raise the price of the tour to cover new fuel surcharges. My question: Can they change the the price of a tour after the tour price was agreed upon and down payment was made? Thank You for your time and help.

Re: Airline fuel surcharges

It depends on the contract you signed with them. My guess is there is some provision which allows them to do this, but it sure won't hurt to check.

Hello. In my opinion, the price cannot be changed. The tour agency is bound to the agreement that you had with it concerning price. Its attempt to change the price amounts to a breach of contract. However, just in case, be careful here. There may be small print that amounts to an exception. Before you contact them, take a look at any agreement that you have to make sure there is no provision that would allow them to increase the price based upon variable expenses.
