Non - compete agreement

I have tax buisness and prior to hiring anyone I have them sign a non - compete agreement. What action can I take if I find out one of my former employees have violated this agreement.

As the previous attorney mentioned, you would be filing a non-compete agreement. Depending on the circumstances you can get fairly substantial damages for these types of agreements because, theoretically, all of his customers could have been your customers.

The trick with these agreements is that they cannot be too broad. You should speak with an attorney about your specific agreement and what your options are moving forward.

Hello. If you discover that a former employee has violated the non-compete agreement, you can file a lawsuit against the former employee for breach of the contract. Such non-compete employment contracts are enforcible because a condition of the prospective employee being hired (consideration) is that the prospect agrees not to compete with the employer. Will be happy to discuss this matter in greater detail. A lawsuit against the former employee should be based upon the damage suffered by you as a result of the former employee competing with you for business.
