Legal Question in Business Law in Illinois

Utour Publishing/ Tanksley-Simpsom Media Group published my book in 2007. The owner, Marc Simpson, has paid me a total of $100 for book sales. He has admitted to having sold more books, stated that he would pay me for those sales, in November 2008, but has failed to do so. He has not returned my repeated messages to his cell phone. His business and home phone numbers are disconnected; I have a home address for him, but am uncertain as to wether this is his current residence.

I would like to sue for monies owed, and, as I requested of him in 2007, have all accounts closed that are associated with his company's sale of my book. Further, I want to ensure that he will be prohibited from any future sales.

How do I proceed?

Wow. So little time, so much information. Where to start? You might start with a full review of your contract. You might elect to sue his company. It might be a small claim, depending on the amount. You may even have recourse against him personally, under certain circumstances. If there's an attorneys' fees provision in your contract (if you have a contract) you may be able to find an attorney to help you. Otherwise, If you're fighting over a small amount, grab a small claims packet from your local courthouse and go from there.

You need to hire counsel to review your contract and conduct an investigation and then if appropriate file a suit against the publisher and/or possibly the individual.
