Legal Question in Civil Rights Law in Illinois

police using scare tactics on kids

9yr old son & 4 others(all latinos) were held against their will at school by police. Accused of beating african american boy. Threatened and intimidated, no parents notified. After all was said and done, nobody confessed, one started making up stories of seeing people hiding behind bushes. I think in attempt to be let go. Police have admitted to making mistake in manner of questioning, school has admitted mistake. Do we have a case? They have all said sorry and expect to move forward as if all is ok. My son was traumatized! Sorry doesn't compare to the effort made in trying to find him guilty.

Re: police using scare tactics on kids

You may have a claim against the police department for violation of your son's civil rights. Typically such claims are for use of excessive physical force or wrongfully jailing a person, but I think your son's age combined with the possible racist undertones make for a strong case.

Feel free to give us a call if you want to call about the details.
