Legal Question in Civil Rights Law in Illinois

Can I sue my exwife over false accusations over a order of protection against my children? We are battling this in court and she is the one that put the order of protection against me, but then again she keeps on asking for more time for this, more time for that. She knows she is lying through her teeth. When it is thrown out in court, which I know it is going speaking with my attorney and hearing the judge and him annoyed by every motion she has put through the court in the past 2 months and her not showing up, can I sue her for defamation of character?

You posted this in the wrong category. It belongs under family law. You can sue anyone for anything, but can you win? - not likely on this set of facts, and you may just irritate the Judge and have this all backfire on you. Think with logic not emotion. What damages are you likely to recover? - zero. What will you spend on the suit? - a fortune. You want to see something get thrown out in court? - try this defamation suit stunt. Now take a deep breath and recognize that the Order of Protection is presumably because she accuses you of being a hothead. File a defamation suit and you sure help her prove her case. Be a sponge not a mirror - absorb the insults, don't bounce them back. What will they matter anyway a year from now, unless you let them? Remember your goal - probably to get time with your kids - and recognize this defamation BS is not going to get you there.
