Legal Question in Technology Law in Illinois

Confidentiality of Internet forums

I am asking about the validity of statements of copyright (most certainly not filed) or confidentiality on internet forums. Is information posted on the internet in a ''private'' forum considered privilaged information? If the ''forum rules'' state that posts may not be copied, reposted, or otherwise used outside of the forum, does that have any legal standing. Could this information be used in the pursuit of a lawsuit in such cases as breach of contract, libel, etc? How do differing states and even nations play a role in this? For instance, if the forum owner and forum host are in California but the plaintiff is in Illinois, defendent in Minnesota, etc. where does the jurisdiction lie? If the forum hosting service states that anything posted is public information, does it matter that the owner/moderators have stated in the forum rules that it is not?
