Legal Question in Construction Law in Illinois

Mechanics Lien

We purchased/built a house through a home building organization that served as general contractor, upon which they received payment in full from us upon closing. One of the sub-contractor's did not receive full payment from our home builder, thus placing a mechanics lien on not only ours, but several other properties.

How do I get the lien removed and do I have any legal stance as far as doing so?

Re: Mechanics Lien

First, check to see if you have an owner's policy of title insurance that may cover this claim for lien. If you have such a policy, of insurance, have me or the attorney of your choice review it to determine if the particular claim of lien is covered. If it is covered, the title insurer is reqponsible to pay the claim or defend your interest in the house from it. If therre is no title insurance, your recouse is against the contractor, and you may have a vaild defense to the claim for lien even if the contractor cannot respond. Hire me or the attorney of your choice to protect your interests in your home.
