furniture sales

Purchased three pieces (floor models) of leather furniture. Told that this sale would be treated as new furniture, not as-is furniture. Refused delivery because work (buffing of leather and arm front needed glued) agreeed upon by sales person was not done on furniture. Told that I ''rushed delivery that is reason work was not done'', by sales person. I told them to cancel my order. I was told that ''we don't give refunds and that you will have to reselect other furniture''. Sales person stated ''you signed a contract to buy furniture''. Yes I did sign for new furniture, those specific pieces to be delivered, not substandard furniture. This purchase was put on my credit card. I disputed the charge immediately, but credit card company told me that the furniture store has final say if dispute will hold.

You may be the victim of a "bait and switch" trick. The company promises you "like new" furniture and then delivers pieces that are falling apart. You probably would have a good case for breach of contract if you wanted to fight with the company, but you have to decide whether it is worth your trouble (and money). I recommend either taking the offer to pick out different furniture, or try pushing the manager for the refund. If he refuses you can go to the Better Business Bureau.

The contract you signed also has some impact on what your options are. I would have to look at it before commenting. Please feel to give us a call if you want to talk.
