Landlord/Tenant Law

I was given a 5-day notice to pay rent which was dated Feb 10th, 2003. I got the notice on Feb 17th. What, if any, recourse do I have? Also what is the next course of action that will occur. Will there be a court appearance or is the sheriff dept next?

It's impossible to give you a complete answer without knowing more facts and looking at your rental contract. The next step depends very much on your landlord. He may attempt to pursue legal action or he may simply be trying to intimidate you into paying.

As for what recourse you have, that (again) depends on the facts. I can tell you that my firm is currently investigating landlords for violations of consumer protection statutes. If your landlord wishes to pursue this, the next step would be to file for ejectment for non-payment of rent. This would involve going to court and as soon as the judge approves it, the sheriffs will come to evict. However, a judge will usually try to give you a chance to pay what you owe and compromise. You should try to talk to your landlord to give you a chance to pay.
