Legal Question in Consumer Law in Illinois

Minor bought a car without permission

I am trying to take back a truck my 17 y/o son bought wihtout my permission. The man said he had to check some things and will get back to me in a couple of days. My son will be 18 in 5 days, if he does not comply in taking the truck back by then, does the contract become enforceable because my son turned 18. My thougt is no because he signed it when he was 17.

The contract will not be automatically invalid. If your son wants to ratify the contract, it will be deemed valid once he is 18. If you son does not want to ratify the contract, it will be possible to have the contract deemed void. It is probably best to deal with it prior to that time, and I imagine the person that sold the truck is trying to bide his time (assuming he know the age of your son).
