poor construction of new driveway

We had a new driveway installed by ''Concrete Contractors'' late summer 1999 and paid the amount of $6,000.00 for the new driveway. Late winter of this year, 2001, when the snow melted, we notice large areas on the drive chipping out or ''pop ups'' as they called it. We had the contractor out to look at it and they blamed it on winter conditions and salt from the streets. The cement dealer stated it was large rock too near the surface of the driveway that swelled during the winter causing the thin layer of cement on top of the rocks to pop off. The only suggestion from the ''Concrete Contractors'' was for us to buy some heavy duty sealer, clean the drive and apply the sealer every fall to see if that ''may'' help to stop future ''pop ups''. I would like to know where we stand legally to be able to deal with this contractor for shoddy work. We think the drive should be replaced.

Sounds like the driveway was installed improperly or with too much water and/or not enough effort. Your remedy is to sue the person who installed the driveway for the cost of removing and replacing it.
