Legal Question in Consumer Law in Illinois
How much are utilties allowed to penalize past due accounts? I'm a tenant trying to work out a resolution of a past tenants water bill , the landlord is a friend who is giving me a great deal on the rent. I don't want to get them involved. the water utility has collected over $470.00 from me but the usury penalty rate is nearly 10% can I take legal action against the utility?

Yes, you can take legal action against the utility company. They never should have charged you for another person's debt. You are not responsible for a prior tenant's utility bills. You should be able to get the full amount of the money you paid to the utility company refunded and damages in the amount of any legal fees you incur if you sue them.
