i brought a car from carcredit on 79 and westrn thy chargd me 30000 for a car only worth 9,000 so i went on and paid for that car 500 per month for5 years so 4years 7 months into the deal my car got total i contact them and told them icould not pay for two cars so let me make a sellement they didnt now they want to sue me can they do that

Yes. Anybody can sue another. I suspect what you really want to know is: does your finance company have a meritorious case and my short response is yes. You signed a contract to pay for the car. I suspect there is nothing in your contract that says: you do not have to make any more payments if your car is involved in an accident and is damaged beyond repair! If there is no such provision, then you are obligated to continue making the payments as you agreed when you signed the contract.

Additionally, just because you want to settle, does not mean the finance company is obligated to settle. You have a contract and they can seek to enforce it if they want to do so.
