Legal Question in Credit and Debt Law in Illinois

Collecting from Defendant after award

I followed all the necessaty filings and citations against a major real estate firm and was granted an uncontested award on February 21,2003. I sent a copy of the Court order to the 3rd party,a local bank by certified mail, received the certified card dated February 24, 2003 and still haven't received a check from withheld assets as of today, March 10th. What is my next course of action?

Re: Collecting from Defendant after award

If you have a Judgment then you will need to file the proper legal documents in order to collect such as an execution or a garnishment. Perhaps the clerk can be of some assistance. Sending a copy of your "award" by certified mail is not legally sufficient.

You must sue to enforce the judgment by having the court recognize your award and forcing the other side to pay.
