Legal Question in Credit and Debt Law in Illinois

Collection Agency won't respond to validation

I recently received a collection notice in the mail for a supposed overdue toll from a 3rd party collection agency. After reading about the FDCPA, I sent them a letter requesting they validate the debt (via certified mail), because I honestly do not believe the debt is mine (I don’t drive on the tollway). It’s been over 30 days, and they have not responded. I don’t want to call them, because I do not want to be harassed. What can I do?

Re: Collection Agency won't respond to validation

While I may not provide you with specific legal advice because you are not as yet my client, in general consumers may want to dispute collection charges in writing, and keep a copy for their files. While the IL Toll Authority may not need to respond, or its collection agency, to your request for a debt validation, if a consumer does go to court to dispute a charge then at that time he/she could bring it up. Too many consumers do not dispute a charge, do not appear or respond to court orders, and suffer wage garnishments, credit score harm, or other damage.
