Legal Question in Credit and Debt Law in Illinois

Consumer Dispute

I received a call from a creditor trying to collect a debt. I asked for a itemized bill showing my how I accrued this bill, but what I was sent was a copy of the contract and the final page of the bill showing how much I owed. The dispute that I have is with the amount of the bill since I didn't receive a bill before hand, that is why I asked for a itemized bill. After they did not send me the correct bill a few months passed and I received a call saying I had a court date without a letter telling me this. i then called the office and again asked for the itemized bill. They told me that they had an itemized bill but that they didn't have to show it to me only to the judge. They also told me they aren't going after me but my cosigner. Do I have any legal rights concerning this matter?

Re: Consumer Dispute

Yes, you do have rights. Their statement they are only "going after the cosigner" does not ring true if they are attempting to collect the debt from you.

My question for you is what is the nature of the court proceeding and its status.

Please feel free to call my office to speak to me or make an appointment regarding this issue.

Very truly yours,

Re: Consumer Dispute

You do have a right to request an itemised statement, however, if they do not wish to give it, you will probably have to wait to go to court in order to enforce that right. However, if you have not been properly served, I am not sure how they expect you to show up to court. You must be summonsed in order for them to get you into court. As for the co-signer, maybe that is who they are suing, not you. They are entitled to go after one of you or both of you.
