Credit Card Collections

We disputed a debt with a company and requested information regarding the debt and hadn't received anything. One year or so later another credit card company has taken it to small claims court. We again disputed the amount and the case was set for trial, 2 months later. We were instructed by the judge to request discovery from the opposing side so that they can prove our debt. We sent two letters, one to the firm and one to the credit card company. The firm said that they receive the request for discovery and said that they will just bring it with them the day of court. The credit card company has sent us nothing. Is this legal? What can we do in our defense.

The judge sets the discovery dates. If they do not comply, you can motion for sanctions. If they show up the date of the hearing with the discovery, you can request a continuance until you evaluate the discovery. If you discover info in the discovery that causes more questions, you can request more discovery.
