Credit card company calling

I have an injury and I cannot work. I cannot get diasablilty or unemployment. Even though I pay this company something every month, they call every day looking for more.I told them I might be going back to work soon. I have other bills to pay. I cannot pay them what they are asking. I know I am over the credit limit and past due. They want me to pay a certain amount before I can see if I will have that amount. How can I make them stop calling every day and take what I can pay them?

Since it is the credit card company calling you, which is the original creditor they are not subject to the Fair Debt Collection Practices Act. This means they can call you everyday, remember you are in default and they have a right to collect the amount due. Yes, like you said you are not able to pay at this time, but that does not mean they have to stop calling you.

The only way to stop the calls and demands for payment is to either 1. Make the payments or 2. File for bankruptcy.
