Legal Question in Credit and Debt Law in Illinois

My doctors office billed my insurance using the wrong codes and it was rejected. I was told not to worry until I received bills for service. By the time I discovery why the claims were rejected it was to late to resubmitt. Am I responsible for their error. If they would have submitted properly the claim would have been paid.

There should be an appeal process through your insurance company. If you did not follow the process of your own insurance company but simply relied on the MD's office for what amounts to advice about your plan, yes you may be liable although the MD's office may be liable to you, but depending on the amount involved and the potential for destroying the relationship you have with the MD, contemplating legal action should be fully appreciated as frustrating a situation as this may be.
