Legal Question in Credit and Debt Law in Illinois

Refund

Over one year ago my credit card was ''overcredited'' $1039.00 for a computer I returned 9 months earlier. I am just now receiving a form from a debt collections agency for the amount ''still owed'' to the company. Am I responsible for paying back the difference even though it was their error and occurred over 1 year ago? (Not to mention the hell I went through with this company for 9 months to get my refund and their reporting me to a credit agency despite my proving to them several times that I returned the merchandise!!!)

Re: Refund

It sounds like your were credited twice for a coputer you returned. If that is the case, you owe the excess amount you were credited. If you have any valid claims against the credit card company, you may be able to legally set-off or deduct the amount they owe you from the amount you owe them, but under your facts I wouldn't recommend trying to do so. While the credit card company may have improperly reported you as delinquent, the effort to attempt a set off, together with possible further damage to your credit, may not be worth the effort.
