Legal Question in Credit and Debt Law in Illinois

My sister has run into a financial bind. She has been unemployed for quite some time .

Her credit card company automatically withdrew hundreds of dollars out of her checking account for payments, unfortunately there were not enough money in the account to cover such payments.

She has now been informed that not only is her credit card company turned over this non-payment matter to a collection agency, but her bank has turned this matter over to an attorney and will be served with papers shortly to appear in court for the funds that they have lost due to the credit card company.

Any advice on how to proceed in this matter would be greatly appreciated. I am not in a position at this time to help her out financially. If she had the funds she would pay all that is owed.

Thank you for your question. Your best bet may be a Chapter 7 bankruptcy. Under the bankruptcy laws, creditors must cease all collection activity once in bankruptcy.
