Unknowingly Buying Stolen Property - Can I get my money back?

My brother in law ''John'' purchased a Chicago Cubs season pass from a co-worker. ''John'' paid $475 for the pass - by personal check to the seller.

At the first Cubs game, my brother in law was approached by security and informed that the season pass was reported stolen. They were hauled away, questioned, and generally embarrased. The ballpark security believed John that he had bought/pd for the tickets - and security wanted name and # of seller etc. They let John go home - end of case - except John is out $475.

My brother in law John has a cancelled check for payment of these tickets. The seller admits to getting the payment. Can John get his money back from the seller? If he refuses to refund my Brother in law's money - can John take it to small claims court? Can you be awarded a refund for stolen property - if you didn't know it was stolen ($475 is a fair price for the 1/2 season bleacher seats). What recourse does my brother in law have?

Yes, I would say you have a claim. He essentially committed a fraud. Most cases that go to small claims get settled so there is a good likelihood that would happen in this case. I would suggest you have an attorney write a letter to the offending party to attempt to have him settle amicably before going to court. The rest is up to you!
