absentee plaintiff on guilty plea
In a domestic battery misdemeanor case, if I enter a guilty plea but the other party doesn't show to court, would the case get dismissed or would they just take the guilty plea on record?
Re: absentee plaintiff on guilty plea
If you choose the plead guilty there will be no trial and the alleged victim need not be in court. It is a class A misdemeanor with a possible penalty of up to 364 days in jail and a fine of up to $2500. These cases may be dismissed if they are set for trial and the victim is a no show. You should have an attorney to help you navigate these issues in a particular case.
