Legal Question in Criminal Law in Illinois

accusation of rape

My son slept with a girl whose fiance and mother found out, and she decided to file rape charges. We received a summons for a ''no contact order'' with an upcoming hearing in two days. We need to know first if he should attend the hearing, and second do we need a lawyer? He is not guilty and does not have a lawyer. Should we attend the hearing, and should we have a lawyer? He has already taken a lie detector test a month ago but has not heard back. No arrests, and nothing else - not even a speeding ticket. His age is 21 and her age 25.

Re: accusation of rape

Your son needs an attorney right now. He must always attend any court hearing where the stakes are so high. If he doesn't attend, a warrant could be issued for his arrest. Depending on the charge, your son is facing years in prison. An experienced criminal defense lawyer will protect him. Do not rely on the fact that your son is innocent. That is an issue for trial. Until then, he is in jeapordy.

Re: accusation of rape

Your son absolutely needs a lawyer. Especially, in these early stages of the investigation/trial.

This information does not constitute an attorney/client relationship. Please call me if you wish to learn more.
