arson/criminal damage to property

how can police charge someone with arson and criminal damage to property if the owner of the property does not press charges

It is in the government's (the State's Attorney's Office) sole discretion whether to press criminal charges. The government may take into consideration the victim's wishes, but it does not have to obey them.
