If you are CONVICTED of battery you MAY.

There are several factors including if you are convicted of a felony or misdemeanor.

Any priors?

You may be eligible for court supervision or a good attorney may be able to get you "alternative" sentencing.

As the above response indicates, you do not provide enough information for an attorney to be able to give much of a response. You need to hire the best criminal defense attorney you can afford in the area where the criminal case is pending. That attorney can interview you for all of the facts, obtain all of the evidence the state has against you, review your record, discuss the case with the state's attorney and then, perhaps, be able to give you the type of response you need. Good luck.
