if you are charged for murder but all evidence is thrown out, can you still get the maximum sentence.

If you are charged with murder and all of the evidence against you has been suppressed, thrown out, how is the state going to be prove you guilty beyond a reasonable doubt? If you are not convicted you cannot be sentenced on that charge.
