Legal Question in Criminal Law in Illinois

My son's 2 college roomates who my son shares a apt. with were arrested for selling drugs (marijuana and possibly ecstasy.) during a raid on thier appt. My son was present during the raid but was not arrested or charged. He was handcuffed while the apt. was searched. The police found no drugs in his room or on his person. He denies being involved but was aware that they were engaged in this behavior.

What if any legal problem might he face? If he is asked to give a further statement, should he ask that a lawyer be present? The police said he could get thrown out of school if he did not tell them what he knew about the situation.

Your son should retain a lawyer and have a confidential conversation with that attorney who would then be in a position to offer advice.
