police taking a legal stament
was it legal for the police detetive to to take the statment from the alleged vicitm over the phone while the victim was in a psychiatric hospital on psych med plus pain med and then signing his name on behalf of the victim then arresting me

Hello. This was totally improper and any claimed evidence based upon this statement should not be admissible at any trial. Of course you should consider this a very serious matter. Definitely get a lawyer right away.
