Legal Question in Criminal Law in Illinois

Rights Violation?

The local police knocked on my door and asked to speak to my son 17 about a girl 15 he was dating. My son asked what they needed and they said that the father of the girl wanted to know if they used a condom? I asked if there were any charges going to be filed and they said no since the legal age was 18 and informed me that the father was just concerned about STD's so all of that said and cleared about no charges being filed i asked my son did you wear a condom and he said yes. 3 days later the police were knocking on my door and wanted him to come to the station to write out a statement. thhey started reading his miranda rights and when i asked what were the charges or if they were going to arrest him he told me that he could not disscuse any thing with me, we declined to make any statements ofcourse. Were any of my sons rights violated on my porch? If there are charges going to be filed dont they have to tell me? what exactly can my son be charged with? HELP as a Parent I am loosing my mind not knowing what is going to happen!

Re: Rights Violation?

Your son can be charged with statutory rape. Since the 15 year old is not at the age of consent they will charge him. What happened on your porch was a police hoax to get a confession and may be supressed depending on the specific facts of the situation. You can contact our office at www.sananlaw.com

Re: Rights Violation?

First of all, please understand that since your son is 17, he is considered an adult under Illinois law. Second, the police do not have to deal with you because your son is 17. The good news is that since she was 15 and he only 17, it's a midemeanor. The bad news is that he'll be a registered sex offender for the rest of his life. Please call me immediately.
