Legal Question in DUI Law in Illinois

DUI Fees??

I have no idea what to expect when I go to court for my dui,

I have a public defender, but have had little contact with him. Is there a range of what the penalties/fines will be?

WIll I have to go to jail?

Will I have to do community service?

How much will the fines be?

I am a 26 y.o. female.

This is my first (and last)DUI.

There was no accident or any damage to any property at all.

I was cooperative.

I did take (and fail) a breathalyzer test.

I blew over 2.0.

I have never had any car accidents, but I have had a few tickets for speeding.

Any insight on what I might expect is very helpful.

If this is your first DUI you are probably eligible for court supervision, which is available providing you get a court approved alcohol and drug evaluation. The fines and fees are often tailored to your ability to pay, and part of the evaluation includes a statement of your income. There are mandatory fines usually a minimum of $460 plue the fine imposed by the judge. It is unlikely that you will do jail time, but without knowing your case in detail, that question cannot be answered. A DUI can carry a penalty of 364 days in jail, so you should be properly represented in this case. There is also the matter of your license suspension that will result from the fact that your breath exam exceeded .08. If you have further questions you can call our office at 630-257-8280.
