Legal Question in DUI Law in Illinois

What are we facing?

My 18 yr son was arrested on a DUI. He flunked the breathalyzer and spent the night in jail. What are we looking at as far as punishment? Is there any way he could be allowed to drive to a job over the summer?

Most first offenders in Illinois get placed on court supervision, and pay between $500 and $2000 in fines and court costs. Alcohol counseling is usually part of a sentence as well.

Your son can petition the court for a judicial driving permit which would allow him to drive for the last 60 of his 90 day suspension.

It is also possible to file what is called a petition to rescind to restore his driving priviliges, if for example, he believes that the police did not have a reason to pull him over.
