Is a DUI conviction a felony?

Under the new statutes effective 1/1/06, DUI can be a felony in many cases. For instance, if you are stopped and the officer smells alcohol on your breath and you don't have a valid drivers license, or you don't have insurance, or you have passengers 16 years old or younger, those are felonies. If you have a suspended or revoked Drivers License, and charged with a DUI, it's a felony. If you get a 6th conviction (even if most were misdemeanors) you get 6 to 30 years in prison, probation is not possible. Typically, no. Specific felony charges have to be brought, otherwise the case is treated as a misdemeanor
