Legal Question in Elder Law in Illinois

Breech of verbal contract

My mother is in a local long-term care facility. When she was admitted, it was agreed to verbally that she would stay on the Alzheimer's Unit for the duration of her stay. Now, they say they want to move her off the unit because she no longer meets the criteria.

Re: Breech of verbal contract

This is typical nursing home behavior. My guess is that the Medicare funds ran out, or they need the bed for a privately-paid patient. That is most often the cause of this behavior.

You have specific legal rights and you cannot be transferred out of a bed without a right to a determination, usually by the state, as to the legality of the discharge.

You may want to consider filing a restraining order against the home. If you have questions please feel free to contact me at the address below, or at 888-717-7575. You may also want to look at www.nursing-home-abuse.net
