Assets and Discovery

June 25, divorce was filed on 8/23 request for assets were sent to opposing attorney 9/10, second request was sent 10/4 Judge order motion to compel in 7 days. Provided incomplete assets at the end of the 7 days. Change of attorneys and process is started all over. 12/12 request assets to opposing attorney, 12/27 a call is made to complete assets, 1/8 second call is made. All marital items was removed from husband and last item is marital home which the judge is forcing the sale even though he removed over 83,000.00 in funds to purchase an apartment building claiming it was premarital. How long before he has to provide assets and discovery? He still is refusing to supply his assets and $5500.00 later I am almost out of attorney funds, he will get $75,000.00 from sale of home which is now on the market. please help.

The other party should pay the legal fees related to enforcing discovery. Your attorney must move the court to force discovery. Ask the court to escrow the funds from sale of the property until parties agree on distribution. Parties often do take advantage of the system but keep pressing and help your attorney to get information on the assets. After spending so much on attorney fees thus far, you shouldn't have to inquire at this site; your attorney should answer these questions.
