changing a child last name

My child father isn't around or in her life. We are now going to court for child support and i still haven't recived anything. since my child was born i been wanting to change her last name do i have to have her father consent on my changing it. Or can I just change it?

Hello. The court will require that dad be given notice, at least, since he is out of the picture.

Usually a change of name is a separate court process, but you should definitely advise the judge in the child support court of your intentions to change your child's name. Will be happy to discuss this matter further and in more detail.

You do not need consent, simply notice. If he does not agree with the name change, he can appear and tell the judge why he does not think its in the best interest of the child. Most fathers do not do this.
