child custody

My husband wants to abopt the child I had with an ex. The ex is not in the picture, he has my contact info. and is not involved. How can I get him to give up his rights over my son through the Child Support Recovery Unit?

The child support recovery unit is not allowed to handle this type of scenario.

The father can chose to give up his rights if the adoption is pending. There are multiple levels of court actions which must be involved. It would be my guess that you will need an attorney to assist you.

Its called a related adoption. If your husband adopts the child, the biological father no longer has to pay support. If the bio father is ok with the adoption, its pretty straight forward. If he contests it, its still very doable, but you have to explain things to the judge a little more. Either way, I recommend getting an attorney for ALL adoptions. They are not simple processes, and I doubt you want an adverse judgment in such a sensitive matter.
