Legal Question in Family Law in Illinois

Child Support

My ex-husband pays his child support every month, but pays on whatever day he feels like it. I may receive payment on the 1st, or the 10th or the 25th of any given month. Do I have any legal rights in requesting that the payment be due on a specific date? It is difficult to budget or pay bills on time,

and he makes me ask him for it every month.

Re: Child Support

Absolutely, it is quite normal for Courts to set a specific date by which payments must be made for child support exactly for the reason you mentioned in your letter, that is... it is difficult otherwise to budget for the month. The first thing you need to do is look at the order that establishes child support payments, if a date is set than all you need to do is file a motion to show cause in which you ask your ex-husband to show the judge why he is not paying on a timely basis. If a specific date is not set, then you need to file a motion to set such date. Either way you have to go to court. Good luck.
