Legal Question in Family Law in Illinois

child support and visitation

Never married my childs father. He has issues with the law. He sends no support and wants visitation. He lives in another state and has no drivers license. How can I prevent this.

From issues with the law, I assume you mean that he has been arrested. His desire for visitation cannot be denied due to his non-payment. However, there are real world, practical, ways to limit or prevent visitation. Feel free to contact my office if you have further questions.

It's not easy to do. IL law treats child support and visitation as separate, ie. someone's failure to pay support is not a reason to deny visitation by law.

From your post I'd ask what are his "issues with the law"? You need to show that he is what our law says is a "serious endangerment" to the child's mental, moral, physical well-being. This certainly can be done and we do this quite often but it's a high bar. Child molester, violent criminals, that sort of thing get visitation stopped. Visitation in jail is generally not allowed.

Please email or call because I really need to hear more about the father to guide you.
