Legal Question in Family Law in Illinois

I am getting a divorce. Before we were married my husband and i had a daughter. In the state of Illinois, do I have to include my daughter in the divorce agreement since she was not born before we were married?

Yes. It doesn't matter that she was born before you were married. She is your daughter.

If the husband is the biological father, or adopted her, the child must be in the JPA (in other words included in the divorce).
