Legal Question in Family Law in Illinois

Hello,

I am an India citizen, eligible for US citizenship next month. Married since 8 years, in India. Have a kid 5 years almost..

Wife walked out a few times in the past citing her own reasons.. and this time again since last 18 days..

1. Can we divorce in US..

2. If both agree for a mutual divorce, how soon can the petition be filed..

3. If both agree to join custody of the child, are there any issues (joint physical custody as well)

4. There are no $ issues.. both agree to just keep what we have of our own..

Thanks very much for your answers..

Regards..

So long as you have met residency requirements in the state in which you seek a divorce, you can divorce there. However, your divorce decree may not be recognized in India. You will have to check the laws of India for this. If you are in Cook County, CARPLS operates a self help desk at Daley Center.
