Legal Question in Family Law in Illinois

My husband wants to leave my 9 year old daughter and I. He plans to move aobut one hour away. What are my chances of getting sole custody? I have called the police a few times when he was breaking things in the house but nothing was done other than my husband leaving for the night. He has threatened to hit me but never does and my daughter sleeps with me because she says she loves him but wants to protect me. BIG Thanks!

A good lawyer lawyer does not give odds. You have an equal chance to obtain custody of your daughter. At this time you each have the right to the custody of the child. Your daughter hopefully loves both of you. If he has been violent and that violence has been witnessed by your daughter that is a factor in determining custody in your favor. There are many factors the court has to consider. Those may resolve in your favor, they may not. The issue is what is in the best interest of the child, considering all the factors.
