I am in the middle of a very contested divorce and will probably go to trial. My STBX does not want the divorce and we are both still living in the home. I want to buy him out, but he wants the house sold, as he does not want me to have it. If I can show the court that I can refinance without him, is it likely that a judge would order the house sold anyway?

Unlikely. Make sure your attorney file a motion to that effect, and take the issue out of the trial. It can be resolved prior to the trial, but I am sure your attorney already knows that.
